Welcome to the EB2 Project! By accessing or using our application and services (the "Service"), you agree to be bound by these Terms of Use ("Terms"). Please read them carefully before using the Service. If you do not agree with these Terms, do not use our Service.
The EB2 Project ("we," "us," or "our") offers a platform that helps users create and manage their EB-2 NIW petitions, providing tools for document generation, organization, and case management. These Terms apply to all users of the Service.
By accessing or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Service.
You must create an account to use certain features of the Service. You agree to provide accurate, current, and complete information during the registration process. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Please notify us immediately of any unauthorized use of your account.

It is the account owner’s responsibility to maintain and store copies of their own files. While the EB2 Project platform provides temporary file storage for petition assembly, we are not responsible for any file loss, regardless of the nature of the loss.
You agree not to use the Service for any unlawful or unauthorized purposes. You agree to comply with all applicable laws and regulations. You agree not to upload or share content that is false, misleading, defamatory, or that infringes upon the rights of others.
The EB2 Project is in a beta version and may contain errors, bugs, instabilities, and other failures. The user agrees to and accepts these conditions when using the Service.
The Service and its original content, features, and functionality are and will remain the exclusive property of the EB2 Project and its licensors. You may not reproduce, distribute, modify, create derivative works, publicly display, or otherwise exploit any of our content without prior written permission.
We reserve the right to suspend or terminate your account and access to the Service at our discretion, without prior notice, if you violate these Terms or engage in activities we consider harmful to the Service or other users. Upon termination, your right to use the Service will cease immediately. If the platform is terminated for any reason, users will be notified 30 days in advance to back up their data. After this period, data will be permanently deleted.
There will be no refund of paid fees in the event of subscription cancellation or account deletion. The subscription will remain active until the end of the current paid period. Canceling before the cycle ends does not result in a refund, and the service will continue until the end of the period.
To the fullest extent permitted by applicable law, EB2 Project shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, service interruptions, or technical failures. The user is responsible for maintaining adequate backups of their files and data.
The EB2 Project will not be responsible for any failure or delay in the performance of its obligations if such failures are caused by events beyond its reasonable control, such as internet failures, natural disasters, cyber-attacks, or any other force majeure events.
The user consents to having their petition data used for training our Artificial Intelligence (AI). Identifiable data will be anonymized to protect privacy. Files will be used to improve our services and will then be permanently deleted.
In the event of subscription cancellation, non-payment, or account deletion, all identifiable data will be immediately pseudonymized. The account will not be recoverable, and a new account will need to be created. The user agrees to back up all their files before canceling the account. Petition data will be used for AI training and then permanently deleted.
All communications, including notices about changes to the Terms of Use, will be made by email or notifications in the user’s control panel. It is the user’s responsibility to keep their contact information up-to-date and regularly check these communications.
All rights to the platform's technology, including software, algorithms, and source code, belong exclusively to the EB2 Project. The user does not acquire any rights to the software. The platform may use third-party libraries subject to specific licenses.
These Terms will be governed by the laws of Brazil. Any disputes arising from the use of the platform will be resolved exclusively in the courts of that jurisdiction.
The EB2 Project implements appropriate technical and organizational measures to protect user data from unauthorized access, loss, or alterations. However, complete security cannot be guaranteed. Using the platform implies certain inherent security risks associated with the transmission of information online.
By using the platform, the user declares that they have read, understood, and agreed to all Terms of Use and the Privacy Policy, including the use of their data for AI training.
